General Court Martial Chairman Lt. Gen. Andrew Gutti has ordered the immediate transfer of Abdullah Kitata from Makindye Military barracks to Luzira prison.
His order was opposed by Kitatta’s lawyer Shaban Sanywa who explained that his client will not be safe while in Luzira.
The former patron of Boda Boda 2010 was Monday appearing before the Military Court but his case was closed prematurely after three remaining witnesses he expected today failed to turn up in Court.
His lawyer said their witnesses including Private Kenneth Okello in charge of Old Kampala Police Armoury , Sgt Allan Matsiko, who was Kitatta’s other body guard and the owner of Vine Tea Hotel where Kitatta was arrested from on February 22, 2018, were duly served with the Army court summons through Police Headquarters at Naguru and at Vine Tea Hotel.
Court Chairman Lt. Gen. Andrew Gutti then asked Kitatta to close his defence case for lack of more witnesses.
Prosecution’s Captain Samuel Masereka applied to Court to have Kitatta transferred from the Military Barracks at Makindye to Kigo prison.
However, Gutti declined and explained that Luzira Prison is nearer than Kigo, and the risk on Kitatta’s life has reduced since the case is coming to an end.
Kitatta and nine other people are facing charges of unlawful possession of firearms, ammunition and Military gears which prosecution says are a monopoly of the UPDF.
Kitatta is expected in Court on April 8 for final submissions in the case before judgment.
