Otafiire rival Kahonda granted bail

Kahonda jubilates outside Court

Jinja High Court has released Ruhuinda County MP Donozio Mugabe Kahonda on bail after he appealed against the nine months sentence.

Kahonda was this year found guilty of forgery by Court.

Kahondo, who retired from the UPDF Officer at the rank of a captain was on June 7  found guilty of eleven counts of impersonation, forgery and uttering false documents by Jinja Chief Magistrates Court. He was accordingly sent to Kirinya Prison in Jinja.

Earlier the Daily Monitor reported that , the charges stemmed from allegations that he uttered a Uganda Certificate of Education [UAC] to UNEB and pretended to be  Mutabazi Levan Dickson whereas not.

He was also accused of having forged a medical report on UPDF entry form at the UPDF Military Academy in Jinja  in the name of Mutabazi Levan Dickson and purported that the same document t was genuine whereas not.

But being dissatisfied with the verdict, he has appealed against it before the Jinja High Court.

He has also applied to be released on bail pending the hearing of his appeal.

“The applicant [MP Kahonda] be granted bail pending the criminal appeal No. 22 of 2017 of this honourable court,”  Kahonda’s bail application read in part.

The legislator who defeated Justice Minister Kahinda Otafiire both in National Resistance Movement party primaries and later in the Ruhinda County Parliamentary elections  had demonstrated exceptional circumstances to warrant his release on bail.

The MP  challenged ing the jurisdiction of the Chief Magistrate’s Court of Jinja for having handled his case that did not originate from within local limits of the court and that the Chief Justice did not also authorise this hearing as provided for under Section 7 of the Magistrates Court Act to cure the illegality, hence its decision was a nullity.

He will appear in Court on June 30th.
