Court has temporarily rejected to hear a state plea to subject Makerere University don Stella Nyanzi to a mental examination.
For months, Nyanzi has been battling cyber harassment charges.
Chief Magistrate James Eremye Mawanda on Tuesday suspended the hearing of application until Constitutional Court rules on Nyanzi’s application which challenges the same.
Eremye explained that Nyanzi’s petition was not challenging her cyber harassment trial, but had to allow the Constitutional Court exercise its jurisdiction and resolve the question of whether the compulsory subjecting of suspects to the Mental Treatment Act enacted during colonial times, was still relevant.
He also declined to grant state request for cancellation of Nyanzi’s bail after prosecution claimed she defied the subjudice rule by attacking Resident State Attorney, Jonathan Muwaganya, who kept turning up in court not ready to proceed.
While the magistrate agreed Nyanzi used a “hard” language against the state attorney in her Facebook posts, he also could not find the said posts to be subjudice.
Court was adjourned to 21st July.
Nyanzi told journalists outside court room that she will fight until she receives justice.
Since last year, Nyanzi has been using her social media to abuse, attack and harass the first family using vulgar language.
She insulted the personal of the President as a pair of buttocks, a statement that landed her to the line of fire.
