The Civil Division of the High Court will deliver judgement on 5th February next year in a case where leader Kizza Besigye accuses the national broadcaster UBC of breach of contract.
Besigye on Monday appeared before Justice Margaret Oguli to testify against Uganda Broadcasting Corporation (UBC) for failing to run his 2011 campaign adverts.
Besigye and his witness lawyer Dan Wandera Ogalo gave testified before Court and thereafter were cross-examined by UBC lawyer Kiryowa Kiwanuka.
Besigye claims he paid Shs. 21Million to run 200 spot messages during presidential campaigns but UBC didn’t run the messages and refused to refund the money.
However Brian Pachuto UBC sales executive director said that Besigye’s cash was refunded.
Pachuto who issued the time orders to run the said adverts, testified that much as Besigye had provided content for his adverts, the UBC editorial team was not there at the time to approve the said content.
Besigye acknowledged this but asked court to condemn the national broadcaster for what he called breach of contract as well as unfair treatment to candidates.
Besigye raised unfairness claims saying the Head of State President Yoweri Kaguta Museveni was favoured and as a candidature enjoyed 90% of the airplay unlike his other opponents.
Justice Oguli set the 5th February 2018 to deliver her judgement.
