Renowned businessman Hamis Kiggundu alias Ham has appealed Court of Appeal decision to reverse his case against Diamond Trust Bank to High Court.

Last Wednesday, three judges of the Court of Appeal; Christopher Izama, Richard Butera and Keneth Kakuru unanimously agreed that Suit should be remitted to the High Court for hearing on the basis of original pleadings.

Diamond Trust Bank (DTB) rushed to challenge Justice Henry Peter Adonyo, the Commercial Court judge’s ruling in which he said that DTB violated the Financial Act of 2004 and therefore directed that the bank refunds 120 billion and be paid with interest of 8% for carrying out illegalities on the Ham’s accounts

But Ham through his lawyer Fred Muwema vowed to challenge Court of Appeal’s ruling in the Supreme Court on grounds that it failed to pronounce itself on the illegality.

“We represent the Respondents in the above appeal. We have been instructed to appeal to the Supreme Court against the whole decision of the Justices of the Court of Appeal given on the 5th day of May 2021. We hereby apply for a certified copy of the Record of Proceedings to enable us prosecute the appeal. Your urgent response shall be highly appreciated. Yours faithfully, Muwema and Co. Advocates,” the application filed in the Supreme Court reads.
