A family in Kisugu, Makindye division in Kampala that is on the verge of losing its prime property to city land grabbers has written to the Chief Justice Alfonse Chigamoy Owiny-Dollo to prevail over corrupt judicial officers aiding the criminals.

RE:DISAPPEARANCE OF COURT FILE MISC. CAUSE NO. 83 OF 2016 AT HIGH COURT CIRCUIT NAKAWA
Ndagire Annet Versus Joseph G.R. Nsubuga (Administrator of the Estate of the late Y. Nsubuga & Commissioner Land Registration)
My Lord, this communication is of immediate and urgent concern.
We are beneficiaries of the Estate of the late YOSEFU NSUBUGA and his son the late JOSEPH G.R. NSUBGUGA who died on 18th June 2021 who were the registered proprietors of very prime land comprised in Kyadondo Block 244 Plot 8324 & Plot 8328 located at Kisugu in Makindye division kampala measuring 1.482 Hectares.
Recently on 8th March 16, 2023 at 3:00AM (at night) land grabbers led by a one Mutabingwa Tonny came onto our land destroyed our home, crops, banana plantation, trees and thereafter fenced off the entire land.
He sub-divided our land into 11 plots and suspiciously and fraudulently transferred 9 (nine) of them into other people’s names within 2 days.
We have lived here as a family with graves of our great grandparents for the last more than 90 years.
We have in our possession the Duplicate Certificate of Title to this land registered in the names of JOSEPH G.R. NSUBUGA as Administrator of the Estate of the late YOSEFU NSUBUGA and the same has never been cancelled, lost or challenged in any Court of law.
When we reported the case to Kabalagala Police Station we discovered that a Court Order vide Misc. Cause No.83 of 2016 allegedly signed by Her Worship Suzan Kanyange (now Judge at High Court Land Division) was used to transfer our land into the names of the Applicant one Ndagire Annet, who thereafter transferred to our tormentor Mutabingwa Tonny.
We questioned the authenticity and genuineness of this Order issued on 20th June 2016 during the life time of our relative (the 1st applicant) but which was being implemented in December 2022 after his death whereas he had never informed us about any case in Court concerning this family land.
So, we wrote to the Registrar High Court on 15th March 2023 and to the Hon the Principal Judge on 27th March 2023 to have the certified record of proceedings where the said order emanated from but up to now, we have never got any response from them hence our decision to seek your very urgent intervention.
We sought and obtained a Police Report on the cases we made against Mutabingwa (which we attach herewith My Lord for your kind perusal) which confirms our deep suspicion that this Court Order was forged since Police has also tried to access the above File but in vain.
In our own investigations we have discovered that the Registrar certified the questioned Court Order on 8th December 2022 and surprisingly cannot produce the Court file now, even after many efforts and reminders from different state actors, including the Principal Judge, Police,State House Anti-corruption, State House Land Desk and state House Legal Department.
There’s a big cartel of land grabbers in the country spearheaded by the same people who include but not limited Annet Ndagire, Paul Mukiibi ( An Advocate of the High Court), Registrar High Court Rosemary Bareebe, Kenneth David Numembi, Kabogoza Dalaus, Registrar of Titles KCCA MZO Francis Banumba, Ronah Agaba (Valuer) Ministry of Lands,Housing and Urbanand Mutabingwa Tonny who used the same script of the Court order at Nakawa High Court Circuit in a similar case Misc. Cause No.582 of 2015 to steal people’s prime land. Copy of the Court Order is attached herewith.
In that case my Lord investigations were carried out by the Office of the Inspector of Courts and the report (which we attach herewith My Lord for your kind perusal) revealed serious fraud and forgery.
We thus appeal to you my Lord to urgently take action so that thefile is retrieved, justice prevails so that the well-connected racket of land grabbers does not steal our land using a forged Court Order.
