NRM Minister Attempts to Create a Municipality within her Constituency Sensing she has Become Unpopular

Kibuku District Councilors have succeeded in a securing an interim order barring the District Speaker Sebano Zerida who is accused of usurping the powers of the Council to approve a Municipality Status for Tirinyi Town Council.

Faustino Waliya, Augustine Majanga and Paul Muloni on behalf of the 22 Councilors rushed to the High Court in Mbale seeking an injunction on the actions of Kibuuku District Speaker who, sources say was executing a directive by the District Woman Representative Hon. Jenipher Namuyangu also State Minister of Local Government.

“Ms Namuyanga has become very unpopular and her fear was that she will not be reelected in 2021. So she had to try all methods to find a constituency for herself,” said an official of Kibuuku District who asked not to be named.

She thus fronted Kibuuku Speaker to elevate a tiny Town Council of Tirinyi into a Municipality.

The Speaker, Zerida wrote to Local Government, a Ministry that Namuyanga heads requesting for approval of the status. A section of councilors has since rejected the move by running to Mbale High Court.

And on the 19th of September, Mbale Mbale Deputy Registrar Lilian Mwandha ruled in favour of the applicants stopping the actions of Kibuuku District leadership.

To prove that Minister Namuyanga is detested, sometime during President Yoweri Kaguta museveni’s countrywide  Operation Wealth Creation Tour, residents of Kibuuku openly denied their MP platform to address them in the eyes of her boss.

TrumpetNews, understands that since then, Namuyanga began to covertly design a plan to return as an MP come 2021.

Further the applicants have written to Speaker of Parliament Rebecca Kadaga informing her of the Court process and requesting that the August House shall not conduct any business arising out of the matters that are being contested before the judiciary.

Dear Madam Speaker, RE: WALUYA FAUSTINO & 2 OTHERS Vs KIBUKU DISTRICT LOCAL GOVERNMENT MISC. APPLN. No. 225 OF 2019 (Arising From Misc. Application No. 224 of 2019) (Arising from Misc. Cause No. 030 of 2019) We refer to the above captioned matter wherein we are counsel for the Applicants and on whose instructions we address you as hereunder;

  1. The Applicants filed a representative action in judicial review on their own behalf and for 22 other Councilors of Kibuku District Local Government.
  2. The matter filed at the High Court at Mbale seeks to review the action of the Kibuku District Speaker, Hon, Sabana Zerida in unilaterally usurping the powers of the Council and unilaterally ruling to approve municipality status for Tirinyi Town Council.
  3. The above action was on the 23rd day of July 2019 and the applicants contend that it was illegal, Irrational and thus ultra vires as it flouted the rules of procedure of the Council.
  4. On the 2506 July 2019, the High Court at Mbale granted an interim order against Kibuku District Local Government staying its enforcement of the orders of the Speaker. The interim order was granted to protect the right to be heard on the cause for judicial review. Copies of the cited interim orders were served upon the ministry of local government and upon the office of the clerk to Parliament.
  5. On the 19th day of September 2019, the high court extended the said interim order for a further two months or until furthest orders of court, within which period the court shall the process forward.
  6. As in the custom of parliamentary conduct our clients expect the August House shall not conduct any business arising out of the matters that are being contested before the judiciary.

The doctrines of separation of powers, contempt of court and subjudice come to mind.
