The Military Court has declined to honour a ruling by High Court Judge Justice Margaret Oumo Oguli, that UPDF doesn’t have the right jurisdiction to try serving police officers.
On Tuesday, the officers’ lawyers Caleb Alaka and Frank Kanduuho presented to the Court Martial a ruling made by the High Court.
But instead Military Court chairman Gen Gutti responded to the order by denying the senior officers including Nixon Agasirwe bail.
He again ordered that all police officers who have in Kigo detention be transferred to Makindye barracks prison. Gutti adjourned Court to Marxh 27, 2018.
Justice Oguli of the High Court had earlier ruled that police Act gives police officers a mandate to hold fire arms without requiring a licence in the course of their duties and thus the Court Martial acted out of its jurisdiction to bring illegal fire arm possession charges against these people.
Lately there is a ‘cold war’ between the military and police with the former upping its ante on arresting several of police officer and their allies who are implicated in heinous criminal activities.
