A court battle between property mogul Sudhir Ruparelia and the Central Bank has taken a new twist with fresh evidence detailing how Bank of Uganda (BoU) lawyers worked for Meera Investment.
Sudhir on Monday swore a new affidavit in rejoinder to the previous ones in which he accused BoU legal officers MMAKS advocates of breach of trust and conflict of interest.
In the fresh affidavit filed before commissioner of oaths, Sudhir divulges; “ as the majority shareholder I have personally instructed Mr. Masembe and MMAKS advocates on a number of transactions for Meera Investments Limited. By the way of example I personally instructed MMAKS Advocates, received and approved a fee note from MMAKS Advocates for work done in the preparation of a sale/purchase agreement and registration of transfers for property comprised in Kyadondo block 208 .”
He adds: “The assertion that MMAKS Advocate have never been my personal lawyers or lawyers of companies in which I have a interest is manifestly false.”
This website further obtained receipts in which MMAKS acknowledged payment of shs 7742000 from Meera Investment as professional fee for transfers of property comprised in Kyadondo block 208.
“We enclose a note our fee for your kind attention,” a tax invoice from MMAKS to Meera Investment reads.
The Central Bank this year sued Sudhir and Meera Investment Limited for causing a financial loss to defunct Crane Bank Limited.
However, Sudhir responded by suing Bank of Uganda (BoU) lawyers Timothy Masembe Kanyerezi and David Mpanga of MMAKS Advocates and AF Mpanga Advocates respectively for breach of trust, conflict of interest and stabbing him in the back.
“In the time I dealt with MMAKSAdvocates I dealt with partners of MMAKS Advocates specifically Mr Timothy Masembe Kanyerezi in relation to companies in which I have an interest like Crane Bank Limited, Meera Investment Limited, Rosebud Limited and Speke Hotel (1996) Limited and in my personal work. Mr Masembe is aware of the extent of my client- Advocate relationship with MMAKS Advocates.
Sudhir’s says that after being advised by his lawyers he verily believes that MMAKS Advocates are necessary, competent and compellable witness.
